How we work together.

These terms govern your use of Atodoc LLC's ("Atodoc", "we") website, practice dashboard, and patient app. Using any of them means you accept these terms. If you are using the patient app, the sections below about the app and SMS are the ones that apply to you most directly.

For practices

Every practice using Atodoc does so under a written master services agreement and a business associate agreement, signed at onboarding. Those documents cover scope of service, uptime expectations, data ownership, indemnification, and termination — and where they conflict with these web terms, the signed agreements win. Service is month-to-month with no minimum term and a clear data-export process if you choose to leave. Request the full agreements any time at info@atodoc.com — we send them the same day.

The patient app

The Atodoc patient app is offered to you by your medical practice: it shows that practice's programs — memberships, rewards, offers, and practice information — and lets you check in and track your activity. The programs themselves (what a reward is worth, what a membership includes, what an offer costs) are your practice's own; Atodoc is the platform, not the party making those offers. Questions about a program belong with your practice; questions about the app belong with us.

You must be at least 13 to use the app, sign in only with your own phone number or email address, and keep your sign-in codes to yourself. You agree not to misuse the service — no attempting to access other patients' or practices' data, probing or disrupting our systems, or using the app for anything unlawful. We may suspend accounts that do.

Not medical advice

The app is for practice programs and information — it is not medical advice, it is not a medical device, and it is not for emergencies. If you are experiencing a medical emergency, call 911. Nothing in the app creates a treatment relationship with Atodoc, and content in the app never replaces the judgment of your care team.

SMS messaging terms

The app uses text messages for one purpose: delivering one-time sign-in codes ("Atodoc sign-in codes"). You receive a message only when you enter your phone number in the app and request a code — messages are always user-initiated, never promotional.

Message frequency varies with your use of the app; typically one message per sign-in request. Message and data rates may apply depending on your mobile plan.

Reply STOP to any message to opt out of SMS. After opting out you can keep signing in with your email address instead. Reply HELP for help, or contact us at info@atodoc.com or (786) 384-5158.

Wireless carriers are not liable for delayed or undelivered messages. See our privacy policy for how we handle your mobile information.

Your data

How we collect, use, and protect information is covered in our privacy policy, which is part of these terms. In short: patient records belong to your practice, we process them on its behalf under a business associate agreement, and we never sell personal information or share mobile information for marketing.

Availability, disclaimers, and liability

We work to keep the service available and accurate, but it is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent the law allows, Atodoc's total liability for any claim arising out of your use of the service is limited to the greater of one hundred dollars ($100) or the amounts you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, special, or consequential damages. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits a practice's rights under its signed agreements.

Termination

You can stop using the app at any time; ask your practice or contact us to delete your account. We may suspend or terminate access for violations of these terms. Practices' termination rights and data-export process are in their signed agreements.

Governing law and changes

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, and disputes belong to the state or federal courts located in Miami-Dade County, Florida. If we make material changes to these terms, we will update the date above and give notice in the app or by email before the changes take effect; continued use after that means you accept them. If any provision is found unenforceable, the rest remain in effect.
